Biography
I specialize in commercial litigation with a focus on federal court cases, including trials. I have extensive experience working with online businesses, particularly in matters related to intellectual property on the Internet in both litigation and non-litigation capacities. My law firm is well-regarded for its expertise in civil rights, employment law, and freedom of speech issues. One of my notable cases involved serving as the lead attorney for Simon Tam in the landmark U.S. Supreme Court case Matal v. Tam, where it was determined that the disparagement clause of the trademark statute infringed upon the First Amendment's protection of free speech. Throughout my career, I have successfully represented clients of various sizes in state and federal courts, as well as in arbitrations and mediations, covering a wide range of litigation areas such as contract disputes, distributorship conflicts, trademark and unfair competition lawsuits, business tort claims, toxic tort and insurance coverage disputes, discrimination and wrongful termination cases, copyright infringement claims, trade secrets, restrictive covenants, and real estate matters. My litigation experience spans from initial pretrial investigations and early dispute resolutions to handling all aspects of bench and jury trials, as well as appellate proceedings. Additionally, my legal blog focusing on copyright, trademark, and related topics, LIKELIHOOD OF CONFUSION®, was acknowledged by the ABA Journal as one of the top 100 law blogs in the nation during its inaugural listing in 2007.
