Biography
Moshe Maimon is a partner at Levy Phillips & Konigsberg, LLP. He specializes in litigation, focusing on intricate personal injury cases related to asbestos, mesothelioma, hazardous substances, pharmaceuticals, faulty consumer goods, medical negligence, consumer deception, and other commercial disputes. Moshe has a track record of successfully litigating some of the most substantial damage awards nationwide. His cases have resulted in several groundbreaking appellate court rulings, including: 2009 - Prevented asbestos brake parts manufacturers from compelling the autopsy of a mesothelioma victim against the wishes and religious beliefs of the deceased and their family. 2008 - Tried and successfully defended a record-breaking $40+ Million judgment on behalf of the family of an advertising executive whose mesothelioma stemmed from asbestos exposure during a college summer job at an auto parts warehouse. 2007 - Tried and successfully defended a $10+ Million judgment against Exxon/Mobil in a pivotal case that established the dual persona doctrine for a peritoneal mesothelioma victim of secondary asbestos exposure. 2006 - Researched, developed, and tried the first successful mesothelioma case holding the largest industrial talc supplier liable for the wrongful death of a former potter. Moshe played a lead role in representing members of the Navajo Nation in their legal battles against companies that deserted uranium mines on the Reservation. Additionally, he led the firm's litigation on behalf of former diet drug patients who suffered heart valve damage. In 1996, Moshe achieved a landmark victory in a repetitive stress injury lawsuit against a product manufacturer in Baltimore, Maryland. Apart from overseeing the firm's pharmaceutical cases, Moshe is involved in managing the firm's commercial litigation cases and their trials. In 2007, he secured a $7 Million verdict (including a $5 Million punitive damage award) in a Breach of Fiduciary Duty case against a prominent NYC law firm. Currently, Moshe heads the ERISA class action section of the firm. Moshe started at the firm while still a student at Brooklyn Law School, where he graduated in 1986. He has lectured on the admissibility standards of scientific evidence in court and effective trial techniques and strategies. Moshe is admitted to practice law in the Federal and State courts of New York, New Jersey, and Washington.
