Biography

David L. Scher has been a partner at Block O’Toole & Murphy since 2012, and assumed the role of President of the New York State Trial Lawyers Association (NYSTLA) in 2023. Before embarking on his career in personal injury law, Mr. Scher was employed at the Office of the New York State Attorney General, volunteered at a Civil Rights legal aid clinic, and served as a clerk for New York Supreme Court Justice Shirley Kornreich. He completed his studies at Tufts University and Fordham University School of Law. Since joining BOM in 2003, Mr. Scher has concentrated his legal practice on representing individuals injured in construction accidents, as well as those who have sustained serious injuries in motor vehicle collisions and other mishaps. Throughout his time with the firm, he has successfully resolved numerous multi-million dollar cases. In 2020, Mr. Scher distinguished himself as the sole attorney in the United States to manage three of the country’s top 50 Settlements. Notably, he secured a $15 million settlement for a wrongful death case and a $12 million settlement for an injured union worker. Mr. Scher is recognized for his adept legal writing abilities and deep understanding of New York State Labor Law. As he oversees the firm’s intricate motion and appellate practice, he pens articles on construction accident law topics published in the New York Law Journal and Bill of Particulars magazine. He was chosen to draft an amicus curiae brief for the New York State Court of Appeals on behalf of 5,000 trial lawyers in a significant case related to a workplace accident; the Court concurred with the brief's stance, broadening the protections for individuals working at dangerous heights. Mr. Scher’s advocacy extends to his work on Fair Labor Standards Act (FLSA) litigation, where he effectively represented restaurant workers and municipal employees who were experiencing underpayment. Additionally, he has provided legal counsel to individuals facing wrongful termination, sexual abuse, and negligent security issues. Beyond his legal practice, Mr. Scher proudly serves as a Committee Member for an annual fundraising event that benefits the St. Jude Children's Hospital.
